Immigration from India to Canada

My main objective to seek Immigration is
earning good money and enjoy a good quality
of life. Why I should not simply go for Work
permit and make money. Why should I
permanently Immigrate?

You must understand that a
Work Permit is a temporary permission for a particular period granted for a particular country.  Most of these permits/visas are coming with certain attached limitations, which should be of concern to you.

In most of these Visas
your spouse is not permitted to work in the country in which you have been granted to work visa.  You are not entitled to avail of various social security benefits available to Permanent Resident and Citizens such as Free Medical, Children's Education at subsidized fees, unemployment Allowance and so on.

Under the circumstances the best thing to do is that
you should apply for Immigration while you are looking for an overseas job and/or if you already have an Overseas Assignment in hand.  Thus, by the time your work Visa/Permit comes to an end, your immigration process will be over and as such you can immediately move to Canada as a permanent Resident.

If you have an Overseas Recruitment Opportunity, while waiting for immigration process, it will also be help you in saving crucial foreign exchange required towards meeting the costs of Immigration and other relevant settlement costs involved.

Does it help if I have a Blood Relation in Canada?
Yes.  From Regulations point of view, the units factor goes high if you have a Blood Relation in Canada.  Included in the Blood Relations are Blood Brother, Sister, Father, Mother, Uncle, Aunt (Maternal or Paternal), Niece, Nephew & Grand Parents.  However, not having a Blood Relation is not a disqualification and one can still qualify for Immigration.

Does it help if I have a confirmed offer of
Employment from Canada while the process is
on?

Yes. However  this offer must be approved by the Canadian Human Resource Center.  It is extremely difficult to get such an approval and the companies avoid the complicated process involved therein.

Can I temporarily visit Canada while my
immigration Application under process?

In case of applications filed under Independent Professional Skilled Category, the issuance of visitors visa to such applicants might not find favor with the High Commission, till the time their application has been disposed of.  However, applicants under the Entrepreneur Category are encouraged to Visit Canada for an exploratory visit.

Can I still apply for the Canadian Permanent
Residence Visa if I have previous refusals for
visitor visas/permanent resident visas?

Yes, You can.

Who is an Entrepreneur?
Canada’s Immigration Regulations define an entrepreneur as an Immigrant:

1)Who intends and has the ability to establish, purchase or make a substantial investment in a business or commercial venture in Canada.

2)Whose business will create or maintain employment opportunities in Canada for one or more Canadian Citizens or Permanent Residents, other than the entrepreneur and his/ her dependants.

3)Who intends and has the ability to provide active and on-going participation in the management of the business or commercial venture.
If you can satisfy a visa officer that you meet this definition you are eligible for immigration to Canada in the entrepreneur Category.

How much money must an Entrepreneur have?
The entrepreneur definition in Canada’s Immigration Regulations sets no fixed minimum net worth amount.  It does require that you have “the ability to establish, purchase or make a substantial investment in a business or commercial venture in Canada that will make a significant contribution to the economy…”. You must also have enough of your own money left over after setting up your business to cover its short-term operating costs and to establish and support yourself and your dependants in Canada.

Must I have previously owned a business in
order to qualify as an Enterpreneur?

No. While experience as the owner of a successful business enterprise will certainly help your chances of being approved, it is not a prerequisite. You should, however, be able to show a history of significant business management responsibility in your career to have a reasonable chance of qualifying in the entrepreneur category.

What role do provincial Governments have in the
entrepreneurial immigrations process?

The provinces role is primarily one of guidance and counselling for applicants who are considering setting up businesses within their borders.  It is in your best interest as a prospective business immigrant to be aware of the particular province’s business development needs and available programs to assist entrepreneurs in setting up businesses to meet those needs.
With the exception of the Province of Quebec, provincial officials are not directly involved in the selection of entrepreneurial immigrants.  The final responsibility for approving or refusing the applications of persons not destined to live in Quebec lies exclusively in the hands of visa officers representing the federal government.

What are the terms and conditions of  an Enterpreneur to get admission to Canada?
The entrepreneur immigrant visas issued to you and your dependants will carry the following terms and conditions related to your business activities in Canada:

  • You must set up, purchase or make a substantial investment in a business that makes a significant contribution to the Canadian Economy.

  • You must participate actively, and on an ongoing basis, in its management.

  • You must create or continue employment for at least one Canadian resident other than yourself and your dependants .

  • You must meet these requirements within two years of your admission to Canada as Permanent Resident.
